TERMS OF SALES
The general conditions of sale are recognized read and approved following an online registration via our website or on site at the nautical base. Any rental of equipment at the Parroudé Nautical Base implies the pure and simple acceptance of these general conditions by the subscriber (person who made the reservation), who undertakes to inform each of the participants of all the terms and conditions.
1. Payment methods
Means of payment accepted: cash, credit card, check payable to Base Nautique du Parroudé, holiday vouchers
2. Terms of reservation
On the internet via our online booking platform administered by Guidap. No precariousness is required. The choice of dates, times, number and type of boat depending on the number and age of participants is the responsibility of the subscriber.
3. Modifications requested by the client
3.1 Cancellation
Any request for cancellation must be made by any means allowing an acknowledgment of receipt to be obtained.
3.2 Change, modification or interruption of the service
In the event of an interruption during the service, the customer or participant cannot claim any refund.
When booking, the choice of dates, times, number and type of boat according to the number and ages of the participants is the responsibility of the subscriber. In all situations where the number of reserved boats does not correspond to the number of practitioners (lower and/or higher than the regulatory capacities of the boats), the Parroudé Nautical Base will in no way be required to find a solution guaranteeing the departure of all the participants.
4. Modification by the Parroudé Nautical Base
4.1 Cancellation
Parroudé Nautical Base reserves the right to cancel or adapt the outing depending on the weather conditions or the level of the participants.
The activity may be canceled for weather, security or other force majeure reasons. In this case, the customer is informed as soon as possible by e-mail or telephone. If the outing cannot be carried out, the service may be postponed according to the following availabilities. If the activity is canceled during the service, for reasons beyond our control, the participants will not be able to claim any compensation.
An appointment time is systematically communicated to you when you make your reservation. For the smooth running of the activities and out of respect for the other participants, we kindly ask you to respect these times. In high season the attendance can be important we advise you to arrive a quarter of an hour in advance. We tolerate a delay of up to 15 minutes. Beyond this period, the boats will be rented again and no refund or compensation will be payable.
4.2 Disqualification
Parroudé Nautical Base reserves the right to exclude, at any time, one or more participants whose behavior would endanger the safety of other customers or their well-being, without any compensation being due to the offending participant.
5. Responsibilities
5.1 Civil Liability
Parroudé Nautical Base is insured for professional civil liability for the rental of nautical equipment (such as canoe - kayak and paddle) that it offers and its liability cannot be engaged for activities reserved with other service providers. She has an insurance contract with Generali la Teste. However, the responsibility of the Parroudé Nautical Base does not replace the individual civil liability which each participant must hold.
5.2 Events outside the Parroudé Nautical Base
Parroudé Nautical Base cannot be held responsible for the partial or total non-performance of the planned service due to events external to it and in particular in the event of:
- incidents attributable to a third party (delay, absence, risky attitude, etc.)
- force majeure (incidents or unforeseeable events: natural disasters, forest fires, weather conditions, etc.)
5.3 Rules of caution and safety
Each participant is aware, given the specific nature of the activities offered, that they may run certain risks due in particular to remoteness, isolation and the specific nature of the environment (river). He assumes them in full knowledge of the facts and he must comply with the rules of prudence.
Instructions are given before each departure. In the case of specific weather conditions, the Parroudé Nautical Base can determine a compulsory route or direction (towards the village). Failure to comply with this instruction directly implies your responsibility.
The services taking place in the natural environment (river and beach), exemplary individual conduct and strict compliance with safety and environmental rules are required of practitioners. Parroudé Nautical Base provides one life jacket per practitioner, this same vest is chosen by the practitioner in compliance with weight standards and is worn by the practitioner throughout the duration of the rental.
Parroudé Nautical Base cannot be held responsible for the individual imprudence of one or more participants.
5.4 Prerequisites and technical level
Our activities are open to everyone; however, depending on the activities and routes, certain conditions must be taken into account (knowing how to swim, age limit, technical level, physical condition, etc.).
Parroudé Nautical Base does not have the means to check the level of sporting practice of its customers.
It is therefore up to each participant to have assessed their physical form according to the choice of routes they wish to take.
For canoe-kayak and paddle activities, it is imperative to know how to swim 25 meters and immerse yourself.
You must not have any medical contraindication to the practice of the chosen activity.
IMPORTANT: You are not the subject of a medical contraindication but you are dependent on special medical care or treatment (asthma, diabetes, etc.) or your state of health requires special attention (fragile joint, problem back, obligatory wearing of glasses, etc.), you must imperatively inform the lessor before the start of the activity and provide the appropriate emergency medication, according to medical recommendations.
5.5 Minors
Parroudé Nautical Base accepts minors provided that their age, physical ability and technical level make it possible to carry out the service under normal conditions.
Before each departure, a signature is requested implying the commitment of the legal responsibility of the signatory on all the minors present and thus gives his agreement by accepting and attesting to having read the general conditions of sale: 'By signing the legal representative, the father or mother certifies the ability of the child or children in his care to swim at least 25 m and to immerse himself as well as to ensure increased supervision throughout the rental and the port of the or life jackets of the whole group'.
6. Materials
6.1 Materials provided
The participant is responsible for the equipment loaned to him for the activity. The professional cannot be held responsible for any damage that may be caused by the equipment made available.
In the event of loss, theft or damage to the loaned equipment, the participant/customer will be asked for compensation related to wear and tear or a total reimbursement of the equipment according to the amounts below:
- Life jacket: 50€
- Paddle: double €30 / paddle €55
- Bottle: 30€
- Fin: 20€
- Kayak / Canoe / Paddle: on estimate
- Shipping costs: 10€
6.2 Materials to be provided
In order to keep a good and unforgettable memory of your ride, remember to bring:
- An outfit adapted to the weather
- Sun protection (cap, t-shirt, glasses, sunscreen, etc.)
- A water bottle
Also avoid wearing jewelry or valuables
Parroudé nautical base cannot be held responsible for the loss, theft (including in vehicles and personal effects deposited in the lockers of the nautical base) or the breakage of objects (eg glasses, cameras, telephones ...) that practitioners could take with them during the activity. The bottle provided is a watertight container but does not in any way constitute an absolute guarantee of protection: improper use or the presence of a bottle of water inside could damage certain personal effects. The Parroudé Nautical Base declines all responsibility in the event of damage to objects placed in the container.
7. Price
The Parroudé Nautical Base prices are presented on the website and at reception. They are divided into three age groups: children (between 5 and 12 years old inclusive), adolescents (from 13 to 17 years old inclusive) and adults (from 18 years old)
The prices include: the chosen service and the loan of technical and safety equipment necessary for the practice of the activity (buoyancy aid vest, paddles).
The loan of certain equipment is possible, free of charge, on simple request (eg: container, waterproof bag, etc.)
8. CNIL
Requests for information and registrations are processed electronically. In accordance with the provisions of Law No. 78-17 of January 6, 1978, you have the right to access and rectify personal information concerning you by mail to the following address SAS les Sanills rue Ludovic Massé 66250 St Laurent.
9. Dispute
9.1 Complaint
Any complaint relating to the service must be sent by the customer to SAS les Sanills rue Ludovic Massé 66250 St Laurent. by registered letter with acknowledgment of receipt, at most one month after the return date, accompanied by all the supporting documents.
9.2 Dispute
The parties will endeavor to resolve amicably any difficulties that may arise in the performance of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and execution of this agreement will be governed exclusively by the rules of French law.
All disputes, of whatever nature, will fall within the jurisdiction of the French civil and commercial courts, including ruling in summary proceedings.
Subject to the status of the plaintiff, any dispute is the exclusive responsibility of the District Court of Perpignan.
